I think they are both defaulting to the same call subroutine: "2ButtonOK:". if you use the compiler (in autohotkey compiler folder) you can set up the icon and when it compiles it has the right icon.

Used Notepad++ and encoding for me is UCS-2 little Endian and I see in Hex "ff fe 0d" in the start of the file.
I think you are probably right about (WritePrivateProfileStringA) as the cause.

Hard to say what code page it is in.
I am using just English characters.
Since I'm using default windows codepage, I'm assuming it is UTF 8.

I take it you don't see that behavior of a blank line (first line) in your ini files when created?

creating ini file leaves one empty line begining of ini file

I create an ini file and there is always a blank line on first line of file.
Is that standard behavior when creating an ini file?
I use win 7 64 bit with AHK 1.1.19.01
